People are currently petitioning electoral candidates to change their to reflect popular vote of the last election rather than electoral college. This article analyzes whether that is legally possible and technically achievable. From a legal stand point of view the article states that other then having to pay a fine electoral candidates can change their votes without breaking the law. On the other hand in the whole history of the United States that has never been done and had never even been attempted.
Question:
1) Can the electoral college elect Hilary Clinton on December 19th?
2) Why would the electoral college never allow this to happen?
3) Why would Obama and Clinton herself oppose such a move?
Yes the electoral college can elect Hillary on December 19th. Electors can go against what their state voted. I believe that there at least 29 states that technically say you cannot do this or else there will be consequences. However, the consequences are pretty light. They mainly get fined from what I've read. However, even if the electoral college did do this, Hillary would still lose. From what I've learned, Congress approves the vote on January 6th. If they sense any roguery from any states they can vote to deny the electoral vote. Therefore they would hand the presidency back to Trump. I believe that Clinton and Obama oppose this because it would make the system less honest. It would go against what the people of many states wanted. Plus they know that the vote can be denied anyway because of Congress is Republican controlled and they would hand Trump the presidency.

Going against the system is something that has never been done, and there has already been widespread acceptance of Trump for president. There are problems with the electoral college, but they will not be changing their votes for this election.
ReplyDeleteI agree with Caroline on the issue because I do not believe our government would change the system for only one election. More so, because Trump has not even had any time in office. Although, I do not believe that Trump's ideas are the best. Since we already elected him president we might as well see what he could do. Therefore, when Trump makes something we disagree with that is when we can protest and worst comes to worse we can impeach him.

ReplyDeleteYes they can elect her on the 19th. I think Obama and Hillary oppose the change because they respect how Donald Trump won the election fair and square. They are being the mature Democrat's that the people prefer to run the country.
ReplyDeleteYes Clinton can be elected on the 19th. However, this will never be done, because then in future elections people will think it is normal to go back and forth between candidates after the final vote.

ReplyDeleteYa, electoral college is not the way to go any more. They would want the electoral college to change their decision because Trump is not a good choice and now they picked him they're looking back like, "um, we messed up on this one"
ReplyDeleteI think it is very possible that something like this might happen, given how the country has never been so outraged about an election before. However I also believe the Electoral College voted the way they did for a reason, and likely are not willing to go back on their decision.
ReplyDeleteIf it were to happen, it would definitely make history, and would be very interesting. I'm sure this country will make as much effort as possible to try and not accept Trump as the president of the United States. Though on the other hand its important to believe in Trump to lead correctly rather than not supporting and protesting. Chances our he will be our president for at least the next four years. We should be preparing for that, nothing else.

ReplyDeleteWhile yes the electors can technically go against their states decision and vote for clinton, I do not think that this has any chance of happening. While the majority vote leans words clinton electors are chosen by their state and they would be to fearfull to go against the candidate that their state voted, ultimately it would be political suicide and they would not be trusted by anyone anymore because they would be outright lying to their states.
